FOR THOSE WHO ARE NEW TO MTN. SHADOWS, WE WELCOME YOU. WE HOPE THAT YOU ENJOY YOUR STAY AND INVITE YOU TO JOIN THOSE OF US WHO HAVE ALREADY PURCHASED LOTS.

OPERATING RULES & REGULATIONS

PURPOSE

THESE RULES AND REGULATIONS ARE INTENDED TO HELP MAKE TIME SPENT AT MOUNTAIN SHADOWS A PLEASANT AND HAPPY EXPERIENCE FOR ALL. THEY APPLY TO LOT OWNERS, NON-OWNER OCCUPANTS AND GUESTS.

AUTHORITY

THESE RULES AND REGULATIONS WERE ADOPTED BY THE BOARD OF DIRECTORS AS PRESCRIBED BY THE DECLARATION

OF COVENANTS, CONDITIONS AND RESTRICTIONS (CC&R), ARTICLE III, SECTION 3.05B AND BECAME EFFECTIVE ON

FEBRUARY18, 2003. THEY REPLACE ALL PREVIOUSLY ISSUED RULES, REGULATIONS, COMMUNITY GUIDELINES AND ARE CONSISTENT WITH CURRENT CC&R REQUIREMENTS AND/OR GOVERNMENTAL LAWS AND REQUIREMENTS.

TRAFFIC SAFETY

MOTOR VEHICLES AND GOLF CART DRIVERS, AS WELL AS BICYCLE RIDERS, ARE REQUIRED TO OBSERVE THE FOLLOWING RULES:

PLEASE – DRIVE SLOWLY – SPEED LIMIT IS 10 MPH., AND OBSERVE STOP SIGNS.

PLEASE – WATCH OUT FOR WALKERS – WHO HAVE THE RIGHT-OF-WAY THROUGHOUT THE RESORT.

NO GOLF CARTS, BICYCLES, ROLLER BLADES, SKATEBOARDS, OR SCOOTERS, ARE PERMITTED ON ANY COMMON AREA WALKWAYS. THE WALKWAYS ARE FOR FOOT TRAFFIC ONLY. EXCEPTION: HANDICAPPED-ASSISTED VEHICLES.

NO ROLLER BLADES, SKATEBOARDS, OR SCOOTERS ARE PERMITTED ON ANY COMMON AREA OR STREET IN THE RESORT.

SECURITY

PLEASE DO NOT GIVE OUT THE GATE CODE TO ANYONE.

“WHEN LEAVING ONE OF THE CLUBHOUSES IN THE EVENING, MAKE SURE THE DOORS AND WINDOWS ARE SHUT AND LOCKED BEHIND YOU.

QUIET HOURS

QUIET HOURS ARE BETWEEN 10PM AND 7AM. TO MAINTAIN THE PEACE AND SERENITY OF OUR RESORT, LOUD NOISES ARE DISCOURAGED AT ALL TIMES.

WATER CONSERVATION

RESIDENTS MUST HELP US CONSERVE WATER. VEHICLES MUST BE WASHED USING A BUCKET AND A HOSE WITH SHUT-OFF NOZZLE. DO NOT ADJUST SPRINKLERS, INCLUDING THOSE IN THE FRONT 5-FOOT SETBACK. PLEASE REPORT SPRINKLER PROBLEMS TO MANAGEMENT.

CLOTHESLINES

EXTERIOR CLOTHESLINES SHALL NOT BE ERECTED, AND THERE SHALL BE NO OUTSIDE LAUNDERING OR DRYING OF CLOTHES.

PROPANE TANKS

PROPANE TANKS OF ALL SIZES MUST BE SECURED TO A STRUCTURE OR A POLE WITH EITHER A CHAIN OR A CABLE.

TWENTY-THREE (23) GALLON TANKS ARE THE MAXIMUM CAPACITY ALLOWED. EACH LOT IS ALLOWED TWO (2) TWENTY-THREE (23) TANKS. TANKS MUST BE TEN (10) FEET FROM ANY POINT OF IGNITION. PER UNIFORM FIRE CODE 1997 SECTIONS 8208, 8209, 7401.8 AND 7401.6

TRASH COLLECTION

NO GARBAGE OR TRASH SHALL BE KEPT ON ANY LOT. ALL TRASH SHALL BE PLACED IN THE DUMPSTERS

PROVIDED. PLACE ALL RECYCLABLE ITEMS (ALUMINUM, NEWSPAPERS, PLASTIC AND GLASS) IN THE TRAILER BINS PROVIDED FOR IT.

ALL TRASH MUST BE PLACED IN BAGS, BOXES BROKEN DOWN AND LIQUIDS PLACED IN SEALED CONTAINERS. DO NOT LEAVE TRASH OUTSIDE THE DUMPSTERS IN THE TRASH COLLECTION AREAS. THE CITY OF HEMET TRASH COLLECTORS WILL NOT PICK IT UP.

HAZARDOUS WASTES, SUCH AS OIL, COOLANT, PAINT, ETC., SHALL NOT BE PLACED IN DUMPSTERS. HAZARDOUS WASTES SHOULD BE TAKEN TO WASTES DISPOSAL SITES OUTSIDE THE RESORT.

OCCUPANCY

NO MORE THAN TWO (2) PEOPLE SHALL RESIDE ON A LOT. “RESIDE,” MEANS ANY RESIDENCY EXCEEDING FOURTEEN (14) CONSECUTIVE OR SIXTY (60) CUMULATIVE DAYS DURING A CALENDAR YEAR.

AGE RESTRICTIONS

THIS PLANNED DEVELOPMENT SHALL BE A “SENIOR CITIZEN’S HOUSING DEVELOPMENT”, AS THAT TERM IS EMPLOYED IN CIVIL CODE S51ET SEQ., AS WELL AS “HOUSING FOR OLDER PERSONS”, AS THAT TERM IS EMPLOYED IN 42 U.S.C. 3601 ET SEQ., AND ANY SUCCESSOR STATUTES TO EITHER. AT LEAST ONE RESIDENT IN EACH DWELLING MUST BE FIFTY-FIVE (55) YEARS OF AGE OR OLDER (THE “QUALIFYING RESIDENT” OR “SENIOR CITIZEN”). EVERY OTHER RESIDENT MUST BE EITHER A “QUALIFIED PERMANENT RESIDENT”, “A PERMITTED HEALTH CARE RESIDENT” OR SOMEONE WHO LAWFULLY RESIDED IN THE DEVELOPMENT ON JANUARY 1, 1985. AS USED IN THIS PARAGRAPH, “QUALIFIED PERMANENT RESIDENT” MEANS A PERSON DESCRIBED IN CIVIL CODE S51.11 OR ANY SUCCESSOR STATUTE THERETO. AT THE TIME OF RECORDATION OF THIS PROVISION, A “QUALIFIED PERMANENT RESIDENT” MEANS A PERSON WHO SATISFIES ALL OF THE FOLLOWING REQUIREMENTS:

  1. RESIDED WITH THE SENIOR CITIZEN PRIOR TO THE DEATH, HOSPITALIZATION, OR ANY OTHER PROLONGED ABSENCE OF, OR THE DISSOLUTION OF MARRIAGE WITH, THE QUALIFYING RESIDENT OR SENIOR CITIZEN;
  2. IS FORTY-FIVE (45) YEARS OF AGE OR OLDER, OR WAS A SPOUSE, OR COHABITANT OF THE SENIOR, OR PROVIDED PRIMARY PHYSICAL OR ECONOMIC SUPPORT TO THE QUALIFYING RESIDENT OR SENIOR CITIZEN;

“QUALIFIED PERMANENT RESIDENT” SHALL ALSO MEAN A PERMANENTLY PHYSICALLY OR MENTALLY IMPAIRED OR TERMINALLY ILL ADULT WHO IS A DEPENDENT CHILD OF THE SENIOR CITIZEN OR QUALIFIED PERMANENT RESIDENT AS DEFINED ABOVE, UNLESS THE BOARD OF DIRECTORS OF THE DEVELOPMENT DETERMINES THAT THERE ARE SPECIAL CIRCUMSTANCES TO DISALLOW THIS PARTICULAR DEPENDENT CHILD AS A QUALIFIED PERMANENT RESIDENT. “COHABITANTS” SHALL MEAN PERSONS WHO LIVE TOGETHER AS HUSBAND AND WIFE, OR PERSONS WHO ARE DOMESTIC PARTNERS WITHIN THE MEANING OF SECTION 297 OF THE FAMILY CODE. “PERMITTED HEALTH CARE PROVIDER,” MEANS A PERSON HIRED TO PROVIDE LIVE-IN, LONG-TERM OR TERMINAL HEALTH TO A QUALIFYING RESIDENT.

OCCUPANT RESPONSIBILITY

  1. EACH LOT OWNER AND NON-OWNER OCCUPANT IS RESPONSIBLE FOR COMPLIANCE WITH THESE RULES AND REGULATIONS.
  2. ALL OWNERS ARE RESPONSIBLE FOR THE CONDUCT OF THEIR GUESTS AND TENANTS.
  3. ALL RENTERS ARE RESPONSIBLE FOR THE CONDUCT OF THEIR GUESTS.
  4. EACH LOT OWNER IS LIABLE TO THE ASSOCIATION FOR ANY DAMAGE TO THE COMMON AREA AND ALL ASSOCIATION PROPERTY.
  5. NEW RESIDENTS (WHETHER OWNERS OR RENTERS) ARE REQUIRED TO CHECK IN AT THE OFFICE PRIOR TO TAKING UP RESIDENCY AND PROVIDE AGE VERIFICATION INFORMATION IN ACCORDANCE WITH FEDERAL AND STATE REQUIREMENTS.

GUESTS

ALL GUESTS UNDER THE AGE OF 18 YEARS MUST BE ACCOMPANIED AT ALL TIMES BY A RESIDENT ADULT. ALL RESIDENT ADULTS ARE RESPONSIBLE FOR THE CONDUCT OF THEIR GUESTS.

PETS

  1. A MAXIMUM OF ONE (1) NORMAL HOUSEHOLD PET IS PERMITTED PER OWNER-OCCUPIED LOT, UNLESS AN EXCEPTION IS MADE BY THE BOARD OF DIRECTORS. GUESTS WITH PETS MUST FOLLOW THESE RULES.
  2. A PET PERMIT MUST BE OBTAINED FROM THE ASSOCIATION OFFICE.
  3. PETS MUST BE KEPT ON THE OWNER’S LOT AND UNDER SUPERVISION AT ALL TIMES WHEN OUTSIDE. IF THE PET IS NOT INSIDE THE RV, IT MUST BE ON A LEASH OR IN A FENCED AREA.
  4. PETS ARE NOT ALLOWED IN ANY BUILDING OR THE FENCED POOL AREA. EXCEPTION: HANDICAPPED-ASSISTING DOGS.
  5. EACH PET OWNER IS RESPONSIBLE FOR THE IMMEDIATE CLEAN UP OF ANY AREA AFFECTED BY THEIR ANIMAL’S ACTIVITIES.
  6. PETS ARE NOT PERMITTED TO BE WALKED THROUGHOUT THE COMMUNITY, EXCEPT THAT THEY MAY BE WALKED ON THE STREETS DIRECTLY TO AND FROM THE RESORT.
  7. “PETS ARE TO BE WALKED OUTSIDE THE RESORT.” PETS ARE NOT PERMITTED TO USE ANY COMMON AREA, INCLUDING THE MAIL AREA AND THE AREAS JUST OUTSIDE THE RESORT’S FRONT FENCES.

POOL AND RECREATION FACILITIES

  1. SUMMER POOL HOURS ARE 7AM TO 10PM. WINTER POOL HOURS ARE 7AM TO 8PM. CLEANING HOURS ARE POSTED. RECREATION BUILDING HOURS ARE 7AM TO 10PM. CHILDREN’S (UNDER 18) WINTER POOL HOURS ARE 11AM TO 1PM AND 5PM TO 6PM. CHILDREN’S (UNDER18) SUMMER HOURS ARE 11 AM TO 1 PM AND 4PM TO 6PM.
  2. ALL USE OF THESE FACILITIES IS AT YOUR OWN RISK. ALL PERSONS ARE REQUIRED TO ABIDE BY THESE AND ANY SPECIAL RULES AND REGULATIONS POSTED IN OR ON THESE FACILITIES.
  3. ANY PERSON MAY BE REMOVED FROM THESE FACILITIES AT THE DISCRETION OF RESORT MANAGEMENT FOR VIOLATION OF ANY RULES AND REGULATIONS, OR FOR ANY CONDUCT CAUSING A NUISANCE OR HAZARD TO OTHERS.
  4. A MAXIMUM OF EIGHT (8) GUESTS PER RESIDENCE ARE ALLOWED TO USE THE POOL UNLESS OTHERWISE APPROVED BY MANAGEMENT.
  5. USE OF OTHER RECREATIONAL FACILITIES BY GROUPS OF GUESTS MUST BE APPROVED BY MANAGEMENT.
  6. CHILDREN (UNDER 18) MUST BE SUPERVISED CONSTANTLY BY AN ADULT RESIDENT. CHILDREN UNDER THE AGE OF 18 SHALL NOT USE THE POOL WITHOUT AN ADULT RESIDENT IN ATTENDANCE.
  7. APPROVED SANITARY POOL GARMENTS MUST BE WORN BY ALL PERSONS (OF ALL AGES), WHO ARE INCONTINENT.
  8. NO RUNNING, DIVING, JUMPING ORHORSE PLAY IN OR AROUND POOL AREA.
  9. NO ONE UNDER THE AGE OF 18 IS PERMITTED IN THE RECREATION BUILDINGS WITHOUT RESIDENT SUPERVISION. THOSE UNDER THE AGE OF 18 ARE RESTRICTED FROM USE OF THE JACUZZI, BILLIARD AND SHUFFLEBOARD FACILITIES.
  10. ALL GUESTS ARE RESTRICTED FROM USE OF THE EXERCISE EQUIPMENT.
  11. SOAP, OILS (SUNTAN), OR SHAMPOO ARE NOT PERMITTED IN THE POOL OR JACUZZI. SUNSCREEN IS PERMITTED. SHOWERING BEFORE ENTERING THE POOL OR JACUZZI IS MANDATORY. SOAP IS NOT TO BE USED IN THE OUTSIDE SHOWER BY THE SWIMMING POOL.
  12. SHIRTS AND SHOES MUST BE WORN INSIDE ALL RECREATIONAL FACILITIES. WET BATHING SUITS ARE NOT PERMITTED.
  13. NO FOOD IS ALLOWED IN THE LOBBY, LIBRARY, AND EXERCISE ROOMS. DRINKS ARE ALLOWED IN ALL AREAS OF THE CLUBHOUSE. ALL CONTAINERS USED IN AND AROUND THE POOL AREA MUST BE UNBREAKABLE. NO GLASS IN THE POOL AREA. ALL REFUSE IS TO BE DISPOSED OF IN PROPER CONTAINERS.
  14. POOL GATES MUST BE KEPT LOCKED AT ALL TIMES.
  15. NO SMOKING INSIDE ANY BUILDING. DISPOSAL URNS ARE TO BE USED OUTSIDE BUILDINGS. PLEASE DO NOT THROW CIGARETTE BUTTS IN THE STREETS OR ON COMMON AREAS.

PARKING

OCCUPANTS (LOT OWNERS OR NON-OWNER OCCUPANTS) MUST PARK ALL VEHICLES ON THEIR LOT. NO VEHICLE MAY BE PARKED ON THE 5-FOOT EASEMENT. IF YOU DRIVE ACROSS THE 5-FOOT EASEMENT TO PARK YOUR VEHICLE, YOU MUST SIGN A WAIVER TO BE RESPONSIBLE FOR ANY DAMAGE IN SAID 5-FOOT EASEMENT. ALL OTHER PARKING AREAS ARE RESERVED FOR OUR GUESTS AND MAY NOT BE USED WITHOUT AUTHORIZATION OF RESORT MANAGEMENT FOR TEMPORARY OR SHORT-TERM USE EXCEPT FOR BUSINESS PURPOSES OR RESORT FUNCTIONS.

TEMPORARY OR SHORT-TERM USE OF COMMON PARKING AREAS MAY BE AUTHORIZED FOR LOT OWNERS ONLY AS FOLLOWS:

  1. A PERMIT MUST BE OBTAINED FROM THE ASSOCIATION OFFICE FOR PERIODS EXCEEDING 24 HOURS OR FOR ANY USE ON CONSECUTIVE DAYS.
  2. PERMITS MAY NOT BE ISSUED IF THE LOT OWNER HAS SUFFICIENT ROOM ON HIS OR HER LOT.
  3. PERMITS MAY NOT BE ISSUED FOR PERIODS LONGER THAN IS CONSISTENT WITH THE NEED.
  4. PERMITS MUST BE PROMINENTLY DISPLAYED IN THE FRONT WINDOW OF THE PARKED VEHICLE.
  5. PERMITS TO AN INDIVIDUAL LOT OWNER MAY NOT BE ISSUED FOR MORE THAN FORTY-FIVE (45) DAYS PER CALENDAR YEAR.
  6. PERMIT IS REQUIRED FOR GUESTS PARKING AN RV OVERNIGHT IN THE GUEST PARKING AREA.
  7. COMMON AREA PARKING IS NOT TO BE USED TO DISPLAY VEHICLES FOR SALE. “FOR SALE” SIGNS ARE NOT PERMITTED.
  8. NO COMMERCIAL USES. NO EQUIPMENT IS TO BE USED FOR A COMMERCIAL BUSINESS, NOR SHALL IT BE MAINTAINED IN THE RESORT.
  9. PERMITS ARE NOT NECESSARY WHEN CONDUCTING OR ATTENDING RESORT FUNCTIONS.

BECAUSE WE MUST MAINTAIN FIRE LANES AND EMERGENCY ACCESS, OVERNIGHT PARKING ON THE STREETS IS PROHIBITED. RV’S MAY BE PARKED IN THE STREET FOR LOADING AND UNLOADING DURING DAYLIGHT HOURS ONLY.

ALL RV’S MUST BE VENTED FOR SEWAGE PURPOSES AND SEWER COLLARS USED ON ALL CONNECTIONS TO THE MAIN SEWER.

NO RV, ITS ACCESSORIES, OR OTHER VEHICLE MAY ENCROACH INTO THE FRONT OR REAR 5-FOOT SETBACKS (EXCLUDING DRIVEWAY) OR THE SIDE 3-FOOT SETBACK AREAS. NO VEHICLE MAY BE PARKED SO AS TO PROTRUDE INTO THE STREETS.

ONLY ONE RECREATIONAL VEHICLE (RV) PER LOT IS TO BE USED FOR LIVING QUARTERS. THIS RV MUST BE A MINIMUM OF 18 FEET IN LENGTH AND APPROVED BY THE ARCHITECTURAL CONTROL COMMITTEE (ACC).

OTHER TRANSPORTATION VEHICLES MAY BE PARKED ON THE LOT, BUT THEY MUST BE MOTORIZED.

NON-OWNER OCCUPANTS MUST HAVE THE POSITION OF THEIR RV ON THE LOT APPROVED BY A MEMBER OF THE ACC OR A BOARD MEMBER.

NO PULL-THRU PARKING FROM ONE LOT TO ANOTHER.

CONSTRUCTION AND LANDSCAPING

ALL CONSTRUCTION, EXTERIOR ALTERATIONS, SHED IMPROVEMENTS AND LANDSCAPING MUST HAVE THE WRITTEN APPROVAL OF THE AC COMMITTEE PRIOR TO THE START OF WORK.

RENTAL

LOTS, IN THEIR ENTIRETY, MAY BE RENTED OR LEASED UNDER THE FOLLOWING CONDITIONS:

  1. LOT MUST BE REGISTERED IN THE ASSOCIATION OFFICE AS A RENTAL LOT.
  2. RENTAL MUST BE FOR A PERIOD OF NOT LESS THAN SEVEN (7) DAYS AND TO NO MORE THAN TWO (2) PEOPLE, ONE OF WHO MUST BE OVER 55 AND THE OTHER QUALIFIED PERMANENT RESIDENT AS DEFINED IN THE CC&R’S IN ACCORDANCE WITH THE REQUIREMENTS OF OCCUPANCY AND OCCUPANT RESPONSIBILITY.
  3. PRIOR TO ARRIVAL, WRITTEN NOTICE MUST BE GIVEN TO THE RESORT MANAGEMENT SHOWING THE TENANT’S NAME AND NEXT OF KIN AND EMERGENCY CONTACT NUMBER. THIS FORM MAY BE OBTAINED IN THE OFFICE.
  4. TENANTS MUST SIGN FOR RECEIPT OF, AND CONSENT TO ABIDE BY, THESE RULES AND REGULATIONS, AND PROVIDE AGE VERIFICATION.
  5. LOT OWNER MUST PROVIDE THE TENANT WITH CLUBHOUSE & GATE KEYS. A MAILBOX KEY MUST ALSO BE PROVIDED UNLESS THE TENANT INFORMS US THAT THEY WILL NOT RECEIVE MAIL AT MTN. SHADOWS.

THE LOT OWNER FORFEITS THE RIGHT TO USE ANY COMMON AREA OR RECREATIONAL FACILITY. SUCH RIGHTS ARE TRANSFERRED TO THE TENANT DURING THE RENTAL PERIOD. THE LOT OWNER RETAINS THESE RIGHTS WITH RESPECT TO ANY OTHER LOT THAT IS OWNED, BUT NOT RENTED. EXCEPTIONS MAY BE GRANTED BY PERMIT FROM THE BOARD OF DIRECTORS.

SALES & RENTAL SIGNS AND ADVERTISING

ALL SALE, RENTAL AND LEASE SIGNS AND ADVERTISING MUST INCLUDE: “55+ SENIOR HOUSING COMMUNITY”.

PENALTIES

THE ASSOCIATION MAY DISCIPLINE ITS MEMBERS FOR VIOLATION OF THESE RULES OR ANY OF THE GOVERNING DOCUMENTS AS FOLLOWS:

  1. SUSPENSION OF VOTING RIGHTS AND/OR ASSOCIATION PRIVILEGES FOR A PERIOD OF UP TO 30 DAYS FOR EACH VIOLATION.
  2. MONETARY PENALTIES OF UP TO $25.00 FOR THE FIRST OFFENSE AND UP TO $100.00 FOR EACH REPEATED OFFENSE.
